These Terms and Conditions ("Terms") govern your use of the Sham Tourism website and related pages, including trip listings, the contact form, and booking enquiries (together, the "Services"). Read them carefully. By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be able to form a binding contract under applicable law to use the Services. If you have an account, you are responsible for keeping your credentials confidential and for activity under that account. Tell us promptly if you see unauthorised use.
2. The Services
The website describes trip programmes and lets you send enquiries. We try to keep information current, but we may change, pause, or remove pages or features at any time. We do not promise that the site will always be available or free of errors. Some functions depend on third-party systems we do not control.
A published programme is an offer to discuss a booking, not a confirmed reservation, until we confirm dates, price, and terms in writing. Entry rules, crossings, and open sites can change. We confirm the current document list before you travel.
3. Acceptable use
You agree not to misuse the Services. You must not:
- Violate any applicable law or regulation;
- Infringe intellectual property or other rights of others;
- Attempt to gain unauthorised access to our systems, other users' accounts, or data;
- Transmit malware, spam, or harmful or deceptive content;
- Scrape, crawl, or harvest data in a way that burdens the Services or breaches these Terms;
- Reverse engineer or attempt to extract source code except where the law expressly allows it.
4. User content
If you send content through the Services (for example a contact message, review, or upload), you grant us a non-exclusive, worldwide, royalty-free licence to use, host, store, reproduce, and display that content as needed to run and promote the Services. You confirm that you have the rights to grant this licence and that your content does not violate these Terms or any law.
5. Intellectual property
The Services, including branding, logos, text, graphics, and software, are owned by Sham Tourism or our licensors and are protected by intellectual property laws. Except for the limited right to use the Services as offered, no rights are granted to you.
6. Third-party links and services
The Services may contain links to third-party websites or integrations. We are not responsible for third-party content, practices, or policies. Your use of third-party services is at your own risk and subject to their terms.
7. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the fullest extent permitted by law, we and our affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services. Our aggregate liability for claims arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us for the Services giving rise to the claim in the twelve (12) months before the claim or (b) one hundred (100) USD, unless applicable law requires otherwise.
9. Indemnity
You agree to indemnify and hold harmless us and our affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
10. Termination
We may suspend or terminate your access to the Services if you breach these Terms or if we are required to do so by law. You may stop using the Services at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive.
11. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue for disputes, unless mandatory consumer protection laws in your country give you the right to bring claims elsewhere.
12. Changes
We may update these Terms. We will post the updated version on this page and change the "Last updated" date. Continued use of the Services after changes take effect is acceptance of the revised Terms, to the extent the law allows.
13. Contact
For questions about these Terms, use the contact form on this website or any contact details listed in the site footer.
